INSOLVENCY PRACTITIONERS ARE TO LOSE INCENTIVE TO WORK?

As explained by Vladimir Shalayev, lawyer, BMS Law Firm, the issue is about making the amount of fee paid to an insolvency practitioner dependent on the insolvency practitioner’s role and contribution to forming the bankruptcy assets. The lawyer comments that the novelty is expected “facilitate mitigation of costs at the expense of a debtor’s bankruptcy assets in the course of bankruptcy proceedings”.

“The situation is twofold: on the one hand, this may motivate insolvency practitioners to work more efficiently; on the other hand, their fee will reduce by several times, and this may have the opposite effect resulting in their losing interest in work”, Vladimir Shalayev concluded.
