Supreme Court reminded that governmental authorities also incur legal costs
Denis Frolov, Partner, BMS Law Firm, noted that in this case courts of various instances disputed whether a defendant should bear legal costs. The Supreme Court of the Russian Federation specified that a defendant may not be released from payment of legal costs only on the grounds that it does not have authority to independently commit actions allowing a claimant to exercise its rights.
“It means that in such cases these costs will be collected exclusively from a defendant, which is not always the case now”, Denis Frolov said.
