Denis Frolov, Head of Litigation and Arbitration Practice, BMS Law Firm, concurs that DIA may sell loan related obligations through tenders, however, the agency cannot be called a collection one, although it may sell debts. In addition, DIA may transfer information on a dishonest borrower to a credit history bureau. This may lead to such a borrower having trouble when taking out a loan in future. “DIA may collect debts through court by filing a relevant claim according to a standard procedure. If a court issues a judgment to collect, it is then passed on to bailiffs”, the expert explained.
